SMS Terms & Messaging Compliance
This page sets the rules for the messages PodControl sends by text message (SMS) and by email. We send a text message only to people who opt in. We send email with the same respect for consent, honest identity, and easy opt-out.
This page is part of our Terms of Service.
1. Who sends the messages
PodControl sends the messages. Our name, address, and contact details are at the end of this page.
2. Text messages (SMS)
Consent. When you give us your mobile number and agree to receive texts, you consent to receive text messages from PodControl at that number. You can give consent on a form, at checkout, in the app, or by texting a keyword to a PodControl number. We ask for consent to marketing texts separately from consent to service texts. Consent is not a condition of any purchase.
Message types. If we text you, the messages fall into two groups.
- Service messages: account alerts, sign-in codes, clips ready for review, a connected account which needs attention, and purchase and support updates.
- Marketing messages: news, offers, and reminders. We send these only if you agreed to marketing texts.
Message frequency. Message frequency varies. It depends on your account activity and your choices.
Cost. Message and data rates may apply. Your mobile carrier sets those rates.
Opt out. Reply STOP at any time to end text messages. You can also reply CANCEL, END, QUIT, or UNSUBSCRIBE. We confirm your opt-out by text. You then receive no more texts from us unless you opt in again.
Help. Reply HELP for help, or email [email protected].
Rejoin. To rejoin, opt in again through a form, a campaign, or a keyword. Your consent resets and messages resume.
Carriers. Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your signal.
Eligibility. You must be 18 or older and be the owner or authorized user of the mobile number.
Your mobile information. We do not sell, rent, or share mobile numbers or text opt-in consent with third parties or affiliates for their marketing or promotional use. We can share them with service providers who help us send messages. Those providers can use the information only for that purpose.
Standards. We follow these rules:
- The CTIA Messaging Principles and Best Practices.
- The Telephone Consumer Protection Act (TCPA) of the United States.
- Canada's Anti-Spam Legislation (CASL).
- The rules of the mobile carriers.
3. Email
- Service email. Receipts, security notices, and notices about your account and your clips. These are part of the Service.
- Marketing email. Product news and offers. We send them to people who agreed to receive them, and where the law allows. People who join the waitlist receive a short series of emails about the launch.
- Every marketing email names PodControl as the sender, shows our postal address, and has a working unsubscribe link. We act on an unsubscribe request promptly, and in every case within 10 business days.
4. Direct messages on social networks
If we contact you by direct message on a social network, we follow the rules of that network. Tell us to stop and we stop.
5. Records of consent
We keep a record of when and how you gave consent, and of when you opted out. This lets us honor your choices and show our compliance.
6. Your choices
Change your mind at any time. Reply STOP to a text. Click unsubscribe in an email. Or email [email protected]. We do not ask you for a reason.
7. Privacy
Our Privacy Policy explains how we handle personal information, including the information we collect to send messages.
8. Changes
We can update this page. We post the new version with a new date at the top. If a change affects how we text you, we ask for your consent again where the law requires it.
